ID DRIVING SCHOOL – TERMS & CONDITIONS

Driving tuition is provided by Dawid Zarnowski, a self-employed DVSA Approved Driving Instructor (ADI) and ELITE Driving School franchisee.

Version 2.7, 26 October 2026.

These Terms are intended to keep lesson arrangements clear and fair for both the pupil and the instructor.

1. BOOKINGS, PRICES AND PAYMENT

Current standard prices are:

  • 2-hour PAYG lesson – £90
  • 2-hour Assessment Lesson – £90
  • 10-hour block – £420
  • Test Day – £126

The £45 hourly rate is a reference rate only; individual 1-hour lessons are not normally scheduled.

Prices may change from time to time, but any change will be communicated before it applies and will not affect tuition already paid for.

Lessons must be paid for in advance unless otherwise agreed with Dawid.

Payment must be received no later than 48 hours before the lesson. If payment has not been received by then, Dawid may release the lesson time to another pupil.

If a lesson is booked less than 48 hours in advance, payment is due when the booking is agreed unless otherwise arranged.

Payment may be made through Total Drive where available, by bank transfer, or by another method agreed with Dawid.

Lesson dates, times, collection points and duration will be agreed with Dawid and may also be recorded in Total Drive.

These Terms & Conditions must be accepted before tuition can begin.

Where ELITE or Total Drive is used for bookings, payments or administration, the relevant ELITE Terms may also apply. If there is a genuine conflict, the ELITE Terms take priority only for the part that conflicts.

2. CANCELLATIONS, ILLNESS AND LATENESS

Please give at least 48 hours’ notice if you need to cancel or rearrange a lesson.

With less notice, you may be charged up to the value of the lesson where Dawid has suffered a fair and reasonable financial loss because the reserved time could not be reused.

Short-notice cancellations can also affect other pupils. A lesson time reserved for you may have been unavailable to someone else, and there may no longer be enough time to offer it to another pupil.

Where reasonably possible, Dawid will try to refill the cancelled time. If the same time is successfully filled, you will not be charged for that refilled time.

Unexpected and serious circumstances will be considered fairly.

Illness

If you are unwell, particularly with contagious symptoms, please tell Dawid as soon as possible.

Driving lessons take place in a close environment. Dawid may decide that a lesson should not go ahead where there is a reasonable risk of illness being passed on.

This also protects other pupils. If Dawid becomes unwell, it may affect lessons for other learners, including pupils preparing for driving tests.

The normal cancellation policy may still apply, but illness will be considered reasonably based on the circumstances, notice given and any pattern of previous cancellations.

Lateness

If you are late, the lesson will normally finish at the original agreed time.

If you are more than 15 minutes late and cannot be contacted, the lesson may be treated as a missed lesson or late cancellation.

If Dawid is late, the lost time will be made up, added to another lesson by agreement, or dealt with through an appropriate credit or refund.

If Dawid cancels a lesson, you will not be charged and any payment will be transferred or refunded.

3. LICENCE, FITNESS, SAFETY AND BEHAVIOUR

You must hold the correct valid driving licence, meet the legal eyesight requirements and provide accurate information about your entitlement to drive.

Dawid may ask to see your licence or a DVLA share code where reasonably required.

You must tell Dawid about any change that affects your entitlement to drive.

You must arrive fit to drive and remain fit to drive throughout the lesson.

You must not take part in a lesson while under the influence of alcohol or illegal drugs.

If medication, illness, extreme tiredness or another condition could affect your ability to drive safely or legally, you must tell Dawid before the lesson.

Dawid may refuse to start or may stop a lesson if he reasonably believes it would be unsafe or unlawful to continue.

If a lesson cannot start or has to be stopped because you arrive unfit to drive, have not disclosed something that affects your ability to drive safely or legally, or because of serious safety or behaviour concerns, the lesson charge may remain payable, up to the value of the booked lesson, where this reflects a fair and reasonable loss.

During lessons you must follow reasonable safety instructions.

Dawid may use the dual controls or intervene through the steering where reasonably necessary to prevent danger or protect people or property.

Abusive, threatening, aggressive, discriminatory, intimidating or seriously inappropriate behaviour will not be accepted.

Serious or repeated unsafe behaviour, refusal to follow reasonable safety instructions or other serious conduct concerns may result in the lesson or tuition being ended.

4. LESSONS, PROGRESS AND VEHICLES

Dawid will provide tuition with reasonable care and skill and adapt lessons to the pupil’s ability, progress and learning needs.

Dawid will provide feedback on progress and, where appropriate, explain what further training or practice is needed.

No particular number of lessons or practical-test pass can be guaranteed.

Dawid’s tuition car will be appropriately insured for professional driving tuition, roadworthy, taxed, have a valid MOT and be fitted with dual controls.

A pupil’s own vehicle may be used only with Dawid’s prior agreement. It must be roadworthy, taxed, have a valid MOT and be appropriately insured for professional driving tuition.

Dawid may ask to see relevant documents and may refuse to use a vehicle that he considers unsuitable or unsafe.

As a general rule, Dawid does not provide lessons in pupils’ own vehicles because of the additional risks compared with using his own dual-controlled tuition car.

5. PRACTICAL DRIVING TESTS

The pupil is responsible for booking and checking their own DVSA theory and practical driving tests.

You are responsible for making sure the date, time, test centre and other details are correct and for bringing everything required by the DVSA.

Using Dawid’s car

Booking a practical test does not automatically reserve Dawid or his car.

If you want to use Dawid’s car, you must tell him the test date, time and test centre as early as possible and at least 4 weeks before the test, unless otherwise agreed.

Use of Dawid’s car is subject to his availability and his professional assessment that you are test ready.

Being test ready means that Dawid is satisfied that you can drive safely, independently and consistently enough to use his car for the practical test. A booked test date on its own does not mean that the car will be provided.

Dawid has a professional responsibility to the pupil, the examiner and other road users. If he believes that you are not yet ready to use the car safely and independently on test, or that doing so would create an unacceptable safety risk, he may refuse or withdraw permission to use the car.

Where reasonably possible, Dawid will explain his concerns and give as much notice as practical so that you can consider other options.

The pupil may still take the test in another suitable vehicle that meets DVSA requirements.

If the test cannot go ahead because of incorrect information, missing documents, lateness or another failure to meet DVSA requirements, the DVSA test fee may be lost and the Test Day charge may still be payable where Dawid cannot reasonably reuse the reserved time.

If Dawid’s agreed vehicle becomes unavailable, he will make reasonable efforts to arrange a suitable alternative. If no suitable alternative can reasonably be provided and the test cannot go ahead for that reason, Dawid will cover the DVSA fee for a replacement practical test.

If the DVSA cancels or changes a test at short notice and Dawid cannot reasonably reuse the reserved time, some or all of the Test Day charge may remain payable.

6. PREPAID LESSONS, REFUNDS AND ENDING TUITION

Prepaid lesson credit should normally be used within 3 months of payment, unless otherwise agreed.

The normal booking and cancellation rules also apply to prepaid lessons.

You may stop taking lessons at any time.

Valid unused prepaid credit will be refunded or credited, less:

  • lessons already taken;
  • lessons already within the 48-hour cancellation period; and
  • any other properly due charge.

Dawid may also decide not to continue tuition where the arrangement is no longer workable.

This may include safety or behaviour concerns, persistent non-payment, repeated cancellations or missed lessons, scheduling problems, or a breakdown of the professional working relationship.

Repeatedly reserving lessons and then cancelling them, or booking so irregularly that lesson times are repeatedly held and released, may also result in Dawid deciding not to reserve further lesson availability.

This is because keeping lesson times available for one pupil can mean turning away another pupil who could have used that time.

Except where immediate action is necessary because of serious safety or conduct concerns, Dawid will give reasonable notice where practical.

7. LIABILITY

Dawid will provide driving tuition with reasonable care and skill.

If a pupil suffers loss or damage because Dawid has failed to use reasonable care and skill or has failed to meet an obligation under these Terms, Dawid may be responsible where required by law.

Where Dawid is legally responsible, this will normally be limited to loss or damage that was a reasonably foreseeable consequence of the breach or negligence.

Nothing in these Terms limits or removes any responsibility that cannot legally be limited or excluded, including responsibility for death or personal injury caused by Dawid’s negligence.

Nothing in these Terms affects the pupil’s statutory consumer rights.

ELITE Driving School and Dawid are separate businesses in the way explained in the applicable ELITE Terms. Dawid remains responsible for his own professional driving instruction and actions as a self-employed Approved Driving Instructor.

8. PRIVACY, PHOTOS AND VIDEO

Personal information will be handled in accordance with UK data-protection law and the ID Driving School Privacy Notice.

Where ELITE or Total Drive is used, their applicable privacy arrangements may also apply.

Identifiable photos or videos will only be used for ID Driving School marketing where separate permission has been given.

Marketing permission is optional and is not required in order to receive driving tuition.

Permission can be withdrawn for future use by contacting Dawid.

9. COMPLAINTS

If you are unhappy with the service, please contact Dawid so the matter can be reviewed.

Complaints should preferably be made in writing to:

hello@iddriving.co.uk

Where relevant, an unresolved complaint may also be raised through the applicable ELITE complaints process or through the appropriate DVSA process for concerns about an ADI’s professional conduct.

This does not affect your statutory consumer rights.

10. BOOKINGS MADE ONLINE, BY PHONE OR MESSAGE

If this agreement is made online, by phone or by message, UK consumer law provides a 14-day cancellation period for qualifying distance contracts.

To cancel during this period, simply tell Dawid clearly by email, WhatsApp, phone or in writing that you wish to cancel. You do not need to give a reason.

If you expressly ask for tuition to begin during the 14-day cancellation period, lessons can start on the agreed date. If you then cancel the tuition agreement during that period, you will be charged a proportionate amount for any tuition already provided before you told Dawid that you wished to cancel.

A request to rearrange or cancel an individual lesson does not cancel the overall tuition agreement unless the pupil clearly states that they wish to end the tuition contract.

These Terms may be updated from time to time. Updated Terms may apply to future bookings, but will not normally change the terms already applying to a lesson that has already been booked unless required by law or agreed with the pupil.
